Purpose

To provide excluded staff members with a discretionary benefit plan.



Definitions

Excluded staff

Excluded managers, excluded professionals and excluded support staff members that, by virtue of their employment roles, have an excluded employment contract with the University.  These positions are out-of-scope and excluded from membership in a union or faculty association, and therefore are not covered under one of the collective agreements. 

Policy Statements

Benefit

The Discretionary Benefit Plan (“Plan”) is available to excluded staff members as agreed upon in their contracts of employment with the University.

Each year, the University will allocate an amount of money for use by eligible members to participate in the Plan in accordance with this policy.
This Plan does not constitute an enlargement of any rights to which an employee is entitled apart from this Plan.

Use of Plan Funds

Each year, the member must allocate Plan funds to one or more of:

Health Spending Account (HSA) - To supplement the member’s health benefits, once each year, members may request up to the annual allocation to be transferred to a Health Spending Account for the member’s use, as outlined in the procedures.  The funds are not taxable and must be used within two years or be forfeited.

Lump Sum Payments - Members may request the allocation to be paid as one lump sum amount, up to the annual allocation.

Professional Development  - After allocations for the above purposes, any remaining funds will be transferred to the member’s Professional Development account. 

General

Any resulting personal tax or other liabilities related to payments and benefits from this Plan are the full responsibility of the member.

The University reserves the right to amend or discontinue the Plan should future conditions warrant such action in the opinion of the University.  No amendment to the Plan shall reduce the benefits that members of the Plan have earned prior to the date of the amendment, and no amendment will compromise plan benefits provided in the members’ employment contracts.
